Free Directory Services:

• Public searchable directory of AMEs and BasicMed physicians
• Basic physician listings with contact information and credentials
• Search functionality by location and services offered
• Access to publicly available and physician-provided information in an easily usable online format

Premium Services for Physicians:

• Enhanced profile listings with additional details
• Direct links to physician external websites
• Priority placement in search results
• Additional marketing and promotional features
• Advanced analytics and performance metrics

• FlightPhysical.com is a directory service only and does not provide individual medical services, personalized advice, or treatment
• We do not guarantee the availability, accuracy, or currency of all information in our directory
• We are not responsible for the actions, qualifications, or services provided by listed physicians
• Directory information is sourced from publicly available FAA data and physician-provided information

For Physicians/Medical Practitioners:

• You must provide accurate, current, and complete information during registration
• You must be a licensed physician (MD or DO) authorized to perform aviation medical examinations, either FAA Aiviation Medical Exams or FAA Approved BasicMed Evaluations using the Comprehensive Medical Examination Checklist (CMEC)
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account

For Pilots and Air Traffic Controllers:

• No account registration is required to search and view directory listings
• Optional account creation may be offered for enhanced features in the future

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that:

• You are legally authorized to enter into this agreement
• All information you provide is accurate and truthful
• You will maintain the accuracy of your information
• Your use of the service complies with all applicable laws

We reserve the right to suspend or terminate your account (even free listings) at any time if:

• You violate these Terms of Service
• You provide false or misleading information
• Your account is used for fraudulent or illegal activities
• You engage in conduct harmful to other users or our platform
• Payment for premium services is not received
• Your clinical practice at a particular location has been inactive for over one year as validated by our internal traffic surveillance, complaint monitoring or cross checking with FAA or other external licensure, accreditation or designation agencies
• We will attempt to notify you if we detect your account or free listing is inactive. If you don't take steps to reactivate your account, your account is permanently deleted 90 days after your first notification, and the web address (eg, FlightPhysical.com/dr-smith , etc ) will be removed from our and Google's indexes and become available to another physician.

You may terminate your account at any time by contacting us at https://flightphysical.com/contact

Premium services are available to qualified physicians through subscription plans. Current features, pricing, and terms are available on our website and may be modified from time to time.

• Subscription fees are charged in advance on a recurring basis (monthly or annually)
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method for all subscription fees
• Prices may change upon 30 days' notice, with changes effective at your next renewal
• Failed payments may result in suspension or termination of premium services

• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel your subscription at any time through your account settings or by contacting us
• Cancellations take effect at the end of the current billing period
• No refunds or credits will be provided for partial subscription periods

Payment processing is handled securely through third-party providers (Stripe and PayPal). By providing payment information, you agree to their respective terms of service and privacy policies.

You agree NOT to:

• Provide false, inaccurate, or misleading information about credentials, licensing, or services
• Impersonate another person or entity
• Use the service for any illegal purpose or to violate any laws
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems or other user accounts
• Scrape, harvest, or collect user data without permission
• Interfere with or disrupt the integrity or performance of our services
• Use automated systems (bots, scrapers) to access the service without our written permission
• Post or transmit spam, advertising, or promotional materials (except as part of your authorized listing)
• Harass, abuse, or harm other users
• Infringe on intellectual property rights of FlightPhysical.com or others

If you are a physician listing your services, you additionally agree to:

• Provide accurate information about your qualifications, services, and availability
• Comply with all applicable medical regulations, privacy laws (HIPAA), and professional standards
• Update your listing information when changes occur
• Not make false or misleading claims about your services
• Honor your published contact information and availability

If you are a pilot or user searching for physicians, you agree to:

• Use the directory for legitimate purposes only
• Verify physician credentials and qualifications independently
• Contact physicians through appropriate professional channels
• Not misuse physician contact information
• Not submit false or fraudulent inquiries

All content, features, functionality, and materials on FlightPhysical.com, including but not limited to:

• Website design, layout, and graphics
• Software, code, and algorithms
• Logos, trademarks, and branding
• Text, images, and multimedia content
• Directory structure and organization

...are owned by FlightPhysical.com and protected by United States and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for their intended purpose. This license does not include:

• Commercial use outside your authorized physician listing
• Reproduction, distribution, or modification of our content
• Reverse engineering or attempting to extract source code
• Removal of copyright or proprietary notices

For physicians who create enhanced listings, you grant us:

• A worldwide, non-exclusive, royalty-free license to use, display, and distribute your listing content
• The right to use your name, credentials, and practice information in our directory
• Permission to use anonymized data for analytics and service improvement

You retain ownership of your content but represent and warrant that:

• You have the right to grant us this license
• Your content does not infringe on third-party rights
• Your content complies with applicable laws and professional standards

Our directory includes links to physician websites and other third-party resources. We are not responsible for:

• The content, accuracy, or availability of third-party websites
• The privacy practices of external sites
• Products or services offered by third parties
• Any damages or losses caused by third-party interactions

We use third-party service providers for:

• Payment processing (Stripe, PayPal)
• Email delivery (Postmark, Mailgun)
• Analytics (Google Analytics)
• Hosting (Amazon Web Services)

Your use of these services is subject to their respective terms and privacy policies.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, completeness, or reliability of directory information
• Warranties that defects will be corrected

We specifically disclaim liability for:

• Actions or omissions of physicians listed in our directory
• Medical malpractice or negligence by healthcare providers
• Inaccurate or outdated physician information
• FAA data that we incorporate into our directory
• Your reliance on any information found on our platform
• Technical failures, service interruptions, or data loss
• Third-party actions or content
• Unauthorized access to your account or data

Before filing any legal claim, you agree to first contact us through our contact page to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably and fairly.

If informal resolution fails, any dispute arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules.

Arbitration Terms:

• Arbitration will be conducted in Denver, Colorado
• The arbitrator's decision is final and binding
• Each party bears its own arbitration costs and attorneys' fees unless otherwise awarded
• Arbitration is on an individual basis only (no class actions)

Exceptions to Arbitration:

• Small claims court actions (under jurisdictional limits)
• Injunctive or equitable relief to protect intellectual property
• Claims that cannot legally be arbitrated

These Terms are governed by the laws of the State of Colorado and the United States, without regard to conflict of law provisions.

For any disputes not subject to arbitration, you agree to the exclusive jurisdiction of state and federal courts located in Denver, Colorado.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms with a new "Last Updated" date
• Sending email notification to registered users (for significant changes)
• Displaying a prominent notice on our website

Your continued use of our services after changes take effect constitutes acceptance of the modified Terms.

We may:

• Modify, suspend, or discontinue any part of our services at any time
• Change pricing for premium services with 30 days' notice, but all annual contracts will be honored at existing rates until the end of the subscription period.
• Add or remove features
• Update technology or infrastructure

We are not liable for any modifications, suspensions, or discontinuations of our services.

You agree to comply with all applicable federal, state, local, and international laws and regulations in your use of our services, including but not limited to:

• Aviation regulations (14 CFR)
• Medical practice laws and regulations
• Privacy laws (HIPAA, GDPR, CCPA)
• Consumer protection laws
• Advertising and marketing regulations
• Export control laws

Physicians listing services must:

• Maintain current FAA AME or state medical licensing
• Comply with FAA regulations for aviation medical examinations
• Follow HIPAA and other healthcare privacy requirements
• Adhere to professional standards of conduct
• Maintain appropriate malpractice insurance
• Comply with state medical advertising regulations

You represent that you are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government list of prohibited or restricted parties.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlightPhysical.com regarding our services and supersede all prior agreements and understandings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. No waiver will be effective unless in writing.

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) will survive termination of these Terms or your account.

Nothing in these Terms creates a partnership, joint venture, agency, employment, or franchise relationship between you and FlightPhysical.com.

These Terms do not create any third-party beneficiary rights except as expressly stated.

These Terms are provided in English. Any translations are for convenience only, and the English version controls in case of conflict.

• Are subject to separate terms if specified
